Marriage/Civil Union License Requirements: 

1. Proof of Identification for both parties:

  • such as a Valid United States issued Driver’s License,
  • United States issued State Identification Card or
  • Birth Certificate (must be original or a certified copy)
  • USA Passport

2. Age Requirement:

Civil Union:

  • Both parties must be 18 years old or older, if either party is under guardianship we need written consent from the guardian. 

Marriage:

  • If both parties are 18 years old or older no parental consent is needed
  • If one or both parties are 16 or 17 Court Order is required. 

3. Have either party been married before or a party to a civil union:

  • Divorced – need the date the most recent divorce was finalized (month, day and year), the Court that did the divorce and the city and state where the divorce occurred. 
  • Death of Spouse- Date and place of death. 

4. Both parties will be asked the following information:

  • Date of Birth
  • City and State of Birth
  • Social Security Number
  • Parents’ names, city and state where parents currently live.  (If parents are deceased they are listed as such.) If one or both parents’ location is unknown, they are listed as such. 

5. Cost of a License is $30.00:

  • Cash
  • Credit Card or
  • Debit Card

6. The License must be used in the State of Colorado within 35 days of being issued.  If License is not used within 35 days, it must be returned to the Clerk and Recorder’s Office to be voided. 

7. If the parties cannot come in together to get the License:

  • An Absentee Affidavit Application would be required for the one that cannot come in. 
  • The Absentee Affidavit must be filled out completely and signed in the presence of a Notary Public.
  • A copy of identification showing proof of age must be provided.

8. Please allow approximately 30 minutes to issue the license.

License Solemnization:

Who can solemnize a license?

  • Judge of a court
  • A Court Magistrate
  • A Retired Judge of a court
  • By a public official whose powers include solemnization of licenses
  • A couple can marry themselves (self-solemnization)
  • In accordance with any mode of solemnization recognized by any religious denomination (minister or pastor)
  • Indian Nation or Tribe

Registration Requirements:

  • The License Certificate must be forwarded to the County Clerk and Recorder shown on the top of the license by the person or party solemnizing the marriage within 65 days after the solemnization to be recorded.
  • Failure to do so shall result in late fees. 

Prohibited Licenses:

  • A marriage/civil entered into prior to the dissolution of an earlier marriage of one of the parties, except a currently valid license between the parties
  • A marriage/civil between an ancestor and a descendant or between a brother and a sister, whether the relationship is by the half or the whole blood.
  • A marriage/civil between an uncle and a niece or between an aunt and a nephew, whether the relationship is by half or the whole blood, except as to marriages/civil permitted by the established customs of aboriginal cultures.
  • Children born of a prohibited marriage are legitimate. 

Common Errors filling out the License:

  • Date and place of ceremony missing.
  • Person officiating did not print official title. (Example: ordained minister or retired judge and etc.)
  • Not signing the license, the way, the couple wants to be known from that point forward.
