MAKE A PLAN TO VOTE!

KNOW THE FACTS FOR COLORADO!

Ever wonder about the write-in line on the ballot?

  • Who can be a write-in?

Colorado Revised Statute 1-4-1101 (1) A person who wishes to be a write-in candidate for an office in an election shall file an affidavit of intent stating that he or she desires the office and is qualified to assume its duties if elected.

(2) No write-in vote for an office in an election shall be counted unless the person for whom the vote was cast filed the affidavit of intent required by subsection (1) of this section within the time prescribed by section 1-4-1102. 

Colorado Revised Statute 1-4-1102(1) the affidavit of intent shall be filed by the close of business on the sixty-seventh day before a primary election and by the close of business on the one hundred tenth day before any other election.  

Colorado Revised Statute 1-7-114(1) Eligible electors may cast a write-in vote for a candidate who has filed an affidavit of intent of write-in candidacy pursuant to section 1-4-1101 by writing the name of the person in the blank space provided for write-in candidates on the ballot for the candidate that filed an affidavit of intent to be a write-in. 

What happens if I write-in the following in the write in area?

  • Micky Mouse
  • Donald Duck
  • My neighbor
  • My dog
  • My best friend
  • A singer/baseball/football/basketball/hockey player, actor/actress etc.

These are not valid write-in candidates, and the vote would not be counted as a valid vote unless the examples above filled out the affidavit of intent to be a write-in by the deadline for that election. 

  • What if I just cross through the candidates I don’t like and write-in who I want for that office?

This would not be a valid write-in vote and the vote would not be counted.
